If your family member died without a will and an administrator has to be appointed to represent the estate of your family member, then the estate will have two years from the date the administrator was appointed to represent the estate.
The statute of limitations is tolled for up to five years for the time period between the date of death and the appointment of an administrator to represent the estate.
